Title: Taipei City Park Management Ordinance

Article Content

Article 1
Taipei city hereby formulates this ordinance in order to strengthen park management and maintain park environment facilities. For other matters not formulated in this ordinance, other laws and regulations shall apply.

Article 2
The term park designated in this ordinance means parks, greens, plaza, children’s playground, and other places for public constructed in coordinated with other public works or set pursuant to laws and regulations that under city administration and developed in accordance with urban planning.

Article 3
The authority of this ordinance is Taipei City Government, the following agencies are pertinent administrative authorities:
1. The administrative authority of parks, greens, plaza and children’s playgrounds under urban planning is Parks and Street Lights Office, Public Works Department, Taipei City Government.
2. The administrative authority of sports parks is Education Bureau of city government.
3. The administrative authority of places for public construction in coordination with public works is the administrative authority of such public works department.
4. The administrative authority of other places for public creation set pursuant to laws and regulations will be determined by its competent authority.
When the competent authority or administrative authority thinks it is necessary, it may authorize the power to its subordinated authority or other authorities subordinated to city government for execution.

Article 4
If enclosure needs to be set at the boundary around the park, it shall be set with plants or proper penetrable facilities.

Article 5
The administrative authority may set the following facilities according to park nature and environmental need:
1. Landscape facilities: trees, flowers, lawn, flower bed, hedge, flower clock, flower stand, green gallery, fountains, water flow, pond, bridge, waterfalls, rockery, sculpture, works of art, stepping stones, garden lamp etc.
2. Rest facilities: kiosk, pavilion on terrace, pavilion, winding corridor, garden chairs etc.
3. Recreation facilities: bunkers, scrawling board, wavy wood, rocking chair, swing frame, seesaw, slewing ring, slide, maze, climbing pole, climbing frame, paddling pool etc.
4. Sports facilities: basketball court, volleyball court, football field, tennis court, badminton field, baseball (softball) field, handball field, hockey field, golf driving range, rugby field, ground track field, swimming pool, spa pool, skating rink, pool table, table tennis table, horizontal bar & parallel bars, suspension loop, amusement park, water skiing field, cricket (croquet) ground, health alameda, runway, bikeway and other sports facilities etc.
5. Social education facilities: botanicl park, ecological park, interesting science park, greenhouse, nursery, aquarium, open-air theater, bandstand, reading room, art gallery, museum, showroom, sundial platform, meteorological observation facility, memorial gateway, monument, observatory etc.
6. Service facilities: administrative office, ticket booth, police box, service center, car park, clock tower, drinking fountain stand, wash basin, toilet, water supply and drainage equipment, lighting equipment, fire fighting equipment, trash bin, mark, fence door, barrier, warehouse, material stacking area, sign board and barrier-free facilities etc.
7. Other facilities as approved by competent authority.

Article 6
Among the facilities mentioned in the preceding article, for the building needs to apply for construction license, it shall be handled in accordance with relevant stipulations of urban planning and building acts.

Article 7
The administrative authority shall establish atlas and document registration inventory of all facilities in the park in accordance with City Property Manangement Act of Taipei City.

Article 8
Administrative authority shall regularly assign personnel to partrol the trees and other facilities in the parks, and carry out complementary planting or repair at any time.

Article 9
If private or institution group intends to donate all kinds of facilities in the park, it shall propose application to administrative authority by attaching design drawing and setting location.

Article 10
For those who with to use the facilities in the park,payment will be charged according to the charging standard determined by the competent authority.

Article 11
The facilities in the parks could consigned to civil institutions for construction, operation, management or maintenance in accordance with Act for Promotion of Private Participation in Infrastructure Projects, City Property Entrusted Operation Management Act of Taipei City and other laws and decrees.

Article 12
The opening hours of park will be announced by administrative authority, unlero under special circumstance as approved by competent authority, the park shall not be closed on Sundays and holidays.

Article 13
The following activities are prohibited in parks under the provisions of Article 13 of the Taipei City Park Management Ordinance:
1. Littering or waste disposal of any kind..
2. Swimming, bathing, washing, fishing, releasing animals into the wild, boating, or other activities that pollute or poison the water, or do harm to plants or animals, in pools and lakes. This prohibition does not apply to boating and line fishing in officially designated areas.
3. Drying clothing or other articles.
4. Driving or riding vehicles without permission, or parking vehicles illegally.
5. Cultivating fruits, vegetables, or other plants without permission.
6. Setting up tables, chairs, boxes, cabinets, or structures of any kind without permission.
7. Using recreational facilities in ways that do not conform to the regulations and cause a threat to safety.
8. Riding bicycles, skating, skateboarding, or golfing in non-designated areas.
9. Bringing in pets or other animals without appropriate protective measures.
10. Writing, carving, or posting bills on park facilities or trees without permission.
11. Urinating, defecating, or other improper behaviors.
12. Vending, renting recreational equipment, or engaging in other profit-making activities without permission.
13. Harming plants, sod, or park facilities; digging up earth, stones, or sod; dumping construction waste; or destroying scenery.
14. Setting campfires, cooking, camping, lighting firecrackers, or erecting shelters or tents.
15. Making excessive noise or creating noise pollution that disturbs public tranquility.
16. Drinking, fighting, or carousing that violates public order.
17. Gambling or other behaviors that do harm to public morals.
18. Bringing in hazardous materials.
19. Doing damage to trees or plants.
20. Engaging in other prohibited or restricted activities as announced by the authorities for contagious disease prevention or park management.

Article 14
When construction with embedding (erecting) underground (ground) objects, the unit in charge shall apply to the administrative authority by attaching relevant drawings and information. Oniy after the approveal and the relevant cost is paid, if reguired the construction can be cousied out works. In case of change or damage on the current facilities, or infringing other’s rights and interests due to the construction, the unit in charge shall be responsible for the repairs and compensation .

Article 15
For assembly, exhibition, speech, performance or other use purposes in the park,except the artistic and cultural activities approved by competent authority, application shall be applied, for large-scale activity with more than five thousand participants, traffic control and management plan shall also be to applied with approval of administrative authority.
The park site use measure and charging standard prescribed in the preceding paragraph shall be determined by competent authority.

Article 16
If any one of the following situations occurs, administrative authority may stop the usage of the park facilities:
1. In violation of this ordinance or park site usage measure.
2. Upon the occurrence of air raid, natural disaster or other accidents.

Article 17
Violators of the provision in Article 13, paragraphs 1-7,10-16,or should be subject unclet.Centrut Government law to a fine of NT$1,200 to NT$6,000.

Article 18
Violators to the provision in Article 13, Paragraph 8, Paragraph 9,should be subje at to a fine of NTD 2,000 to 10,000.
Those bringing savage aminals into a park without accompanying adult or without appropriate protective measures,subject to a fine of NTD 20,000 to 100,000 shall be imposed.

Article 19
Violators of the provisions in Artivle 13, Paragraph 17, Paragraph 18 shall be turn over to the police.

Article 20
Violators of the provisions in Artivle 13, paragraph 19, shall be required to pay compensation in accordance with the standards stipulated in the Taipei City Regulations Governing the Management and Maintenance of Roadside Trees. If protected trees are destroyed, however, the matter shall be handled in accordance with the Taipei City Management Ordinance for Tree Protection..

Article 21
The fine punishment stipulated in this ordinance shall be imposed by administrative authority.
The fine imposed in accordance with this ordinance shall be paid within a time limit as per notice, in case of failure of payment in due time, it shall be transferred for compulsory execution, pursuant to law.

Article 22
This ordinance will take effect as of the date of publication.
